Kathy Hochul\u2019s attempts to circumvent the state legislature by using an executive order to revive a generous tax incentive for developers that <\/span><a href=\"https:\/\/commercialobserver.com\/2022\/06\/421a-replacement-new-york\/\"><span style=\"font-weight: 400\">expired last summer<\/span><\/a><span style=\"font-weight: 400\"> has not been well received among lawmakers.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Multiple New York state lawmakers said they were not <\/span><a target=\"_blank\" target=\"_blank\" rel=\"noopener\" href=\"https:\/\/nysfocus.com\/2023\/07\/07\/hochul-housing-tax-break-421-a\"><span style=\"font-weight: 400\">clued in to reported conversations<\/span><\/a><span style=\"font-weight: 400\"> the governor had with real estate and labor leaders over how to create a substitute to the 421a program that would allow owners to recoup a similar amount of cost savings on their projects in place of the tax break.<\/span><\/p>\n<p><span style=\"font-weight: 400\">\u201cI don\u2019t think one can deal with a housing crisis truly behind the scenes without the legislature as a partner. That\u2019s the wrong way to get something done,\u201d Linda Rosenthal, an Assembly member from Manhattan who chairs the Assembly\u2019s Housing Committee, told Commercial Observer. \u201cThere needs to be all perspectives on the table, and discussion among a broad coalition.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400\">A spokesperson for Hochul did not respond to a request for comment.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Lawmakers left Albany last month without reaching a <\/span><a target=\"_blank\" target=\"_blank\" rel=\"noopener\" href=\"https:\/\/www.politico.com\/news\/2023\/06\/09\/new-york-housing-deal-collapse-00101100\"><span style=\"font-weight: 400\">housing deal<\/span><\/a><span style=\"font-weight: 400\"> after the governor and legislative leaders failed to reach consensus on an array of new tenant protections, provisions to increase housing density, mandates for suburban housing development, or measures to allow office space conversions. A proposal to apply<\/span><a href=\"https:\/\/commercialobserver.com\/2023\/06\/new-york-housing-deal-hochul-heastie\/\"><span style=\"font-weight: 400\"> the abatement<\/span><\/a><span style=\"font-weight: 400\"> to mixed-income projects that had begun construction but could not be finished by the law\u2019s June 2026 deadline also failed to gain momentum.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Assemblymember Maritza Davila of Brooklyn was disappointed that the state legislature didn\u2019t pass any housing measures but said the key issue holding back the tax incentive was that lawmakers wanted greater levels of affordability for rental units \u2014 about 40 to 80 percent of area median income levels \u2014 than developers were willing to offer.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">\u201cWe have a huge homeless population. Where are we supposed to put all of these homeless people? How are we supposed to accommodate them?\u201d Davila said. \u201cWe have to build. The housing stock is not being built, but we have to be able to buckle down and fight. And if that means saying no, that means saying no.\u201d\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">Once the legislative session was over, Hochul floated the idea of issuing an executive order that would establish a payment-in-lieu-of-taxes program for developers run by the city\u2019s economic development corporation, which would transfer their leases to the city and receive a property tax abatement in return.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">Hochul conferred with the Real Estate Board of New York and the Building and Construction Trades Council on the specifics of the potential 421a replacement, <\/span><a target=\"_blank\" target=\"_blank\" rel=\"noopener\" href=\"https:\/\/nysfocus.com\/2023\/07\/07\/hochul-housing-tax-break-421-a\"><span style=\"font-weight: 400\">New York Focus<\/span><\/a><span style=\"font-weight: 400\"> and <\/span><a target=\"_blank\" target=\"_blank\" rel=\"noopener\" href=\"https:\/\/therealdeal.com\/new-york\/2023\/07\/10\/stopgap-421a-held-up-by-construction-wage-dispute\/\"><i><span style=\"font-weight: 400\">The Real Deal<\/span><\/i><\/a><span style=\"font-weight: 400\"> reported.<\/span><\/p>\n<p><span style=\"font-weight: 400\">But REBNY and Building Trades \u2014 groups that <\/span><a target=\"_blank\" target=\"_blank\" rel=\"noopener\" href=\"https:\/\/therealdeal.com\/new-york\/2019\/11\/07\/rebny-building-trades-join-forces-on-development-policy\/\"><span style=\"font-weight: 400\">in 2019 agreed to have a unified front in pushing policy decisions to lawmakers<\/span><\/a><span style=\"font-weight: 400\"> \u2014 couldn\u2019t agree on the plan. REBNY supported the measure, but Building Trades insisted the order include wage guarantees that would apply to all projects that receive a tax break.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Instead, REBNY balked and the governor pulled the measure without ever making a public announcement.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">\u201cIn the <\/span><span style=\"font-weight: 400\">absence of such policies, the city\u2019s housing supply crisis will continue to worsen,\u201d REBNY President James Whelan said in a statement.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Gary LaBarbera, the leader of Building Trades, did not respond to a request for comment.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Labor leaders and their allies warned that an affordable housing tax abatement without a prevailing wage requirement would never be acceptable in any negotiation.<\/span><\/p>\n<p><span style=\"font-weight: 400\">\u201cThe whole point of tackling the housing crisis is to make New York an affordable place to put down roots and support your family,\u201d Jessica Ramos, a state senator from Queens and chair of the Senate Labor Committee, said in a statement. \u201cHousing justice requires safe, family-sustaining jobs as part of a greater strategy. With more day laborers in our job market than ever, this move would have resulted in a proliferation of dangerous job sites and a lowering of construction standards that make the sector safer for all workers.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400\">Hochul could try again to resuscitate the <\/span><span style=\"font-weight: 400\">tax incentive, but when it comes to taxes and housing policy, the governor\u2019s powers have their limits.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">She could declare a state of emergency and attempt to extend the deadline by which properties would qualify for the incentive\u2019s benefits. Gov. Andrew Cuomo made a similar maneuver in 2018 to <\/span><a target=\"_blank\" target=\"_blank\" rel=\"noopener\" href=\"https:\/\/www.wsj.com\/articles\/gov-cuomos-order-gives-green-light-to-citys-speed-camera-plan-1535405918\"><span style=\"font-weight: 400\">turn on speed cameras<\/span><\/a><span style=\"font-weight: 400\"> in school zones for 30 days when the Republican-led Senate let the program <\/span><a target=\"_blank\" target=\"_blank\" rel=\"noopener\" href=\"https:\/\/nyc.streetsblog.org\/2018\/08\/27\/governor-cuomo-signs-speed-cams-executive-order-heres-four-things-you-need-to-know\"><span style=\"font-weight: 400\">expire<\/span><\/a><span style=\"font-weight: 400\">.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">But legislators doubted that Hochul had the unilateral authority to change the 421a deadline, which is written into state law.<\/span><\/p>\n<p><span style=\"font-weight: 400\">\u201cNo one could contest that there isn\u2019t a housing emergency in the city or state. But that said, I\u2019m not sure how statutorily she might be able to do that,\u201d Manhattan state Sen. Brad Hoylman-Sigal said.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">Lawmakers instead suggested convening a special session in the fall to tackle housing, or hold a summit in which developers, labor unions, tenant groups and public officials hash out solutions to the state\u2019s shrinking housing supply.<\/span><\/p>\n<p><span style=\"font-weight: 400\">\u201cShe knows that we should be full partners for tackling the housing crisis,\u201d Rosenthal said. \u201cShe obviously knows about it from her travels and her point of view, but we also talk to people and have our own opinions. This is something we need to tackle together.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400\">But real estate insiders believe elected officials could be waiting a long time for either side involved to offer any concessions.<\/span><\/p>\n<p><span style=\"font-weight: 400\">\u201cYou have powerful economic interests versus mass mobilized tenants,\u201d said Ken Fisher, a land use attorney with Cozen O&#8217;Connor. \u201cWe found creative solutions in the past but we\u2019ve had 20 years of prosperity, and the upshot of that is nobody feels the pressure to compromise.\u201d<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gov.
