The directive was issued on Saturday by a constitutional bench headed by Justice Adnan-ul-Karim Memon while hearing petitions filed by ethnic Bengalis who alleged they were being prevented from leaving Pakistan despite holding valid travel permits issued by the Bangladesh High Commission. During the hearing, counsel for the petitioners informed the court that the applicants had secured travel permits using Bangladeshi documents, but FIA immigration officials were refusing to allow them to depart from Pakistan. The petitioners also complained of harassment while obtaining the required No Objection Certificate (NOC), despite their stated intention to permanently settle in Bangladesh. Representing the government, the law officer argued that the applicants’ travel documents must first be verified by Pakistan’s Ministry of Foreign Affairs. He further submitted that authorities would examine the petitioners’ records with NADRA, block any Pakistani identity cards found to have been issued to them, and complete legal proceedings under the Foreigners Act before permitting their departure. The constitutional bench observed that although the right to leave the country is subject to legal restrictions and due process, government agencies cannot disregard legal obligations related to immigration clearance, identity verification, and deportation procedures. The court ruled that once valid travel permits have been issued, the relevant authorities are responsible for completing all legal formalities without causing unnecessary delays. Justice Memon directed the FIA to refrain from creating unnecessary hurdles and instructed authorities to complete the petitioners’ repatriation to Bangladesh—or deportation where applicable—in accordance with the law.
