Rajah & Tann Singapore successfully acted for the respondent in 𝘋𝘙𝘖 𝘷 𝘋𝘙𝘗 [2025] SGHC 255, in resisting a challenge to an arbitration tribunal’s jurisdiction under section 10(3) of the International Arbitration Act. This is the first reported Singapore decision which held that a failure to comply with preconditions to arbitration is a matter of admissibility, not jurisdiction. This brings the Singapore position in line with recent English and Hong Kong decisions, and clarified the Court of Appeal’s approach in 𝘐𝘯𝘵𝘦𝘳𝘯𝘢𝘵𝘪𝘰𝘯𝘢𝘭 𝘙𝘦𝘴𝘦𝘢𝘳𝘤𝘩 𝘊𝘰𝘳𝘱 𝘗𝘓𝘊 𝘷 𝘓𝘶𝘧𝘵𝘩𝘢𝘯𝘴𝘢 𝘚𝘺𝘴𝘵𝘦𝘮𝘴 𝘈𝘴𝘪𝘢 𝘗𝘢𝘤𝘪𝘧𝘪𝘤 𝘗𝘵𝘦 𝘓𝘵𝘥 [2014] 1 SLR 130, which treated preconditions to arbitration as going to the tribunal’s jurisdiction. Upholding a worldwide freezing order issued by the SICC, the Court provided important guidance on the thresholds for Mareva injunctions and the application of section 12A of the International Arbitration Act.
