Spirit Airlines was one of the most notable companies to be hit, but Erin says many of the transportation companies that have filed for Chapter 11 relief this year are smaller trucking companies "that are really hurting under the price of fuel, the price of diesel." Armstrong Teasdale successfully defended the Missouri Prosecuting Attorneys and Circuit Attorneys' Retirement System (PACARS) in class action litigation challenging the constitutionality of a surcharge imposed by Missouri courts in criminal cases. The surcharge supplies crucial funding for the retirement system, which provides retirement benefits for Missouri prosecutors and the Circuit Attorney of the City of St. Louis. After securing judgment on the pleadings in the Jackson County, Missouri Circuit Court, the team successfully defended that ruling before the Missouri Court of Appeals, which also vacated an earlier court order finding the surcharge unconstitutional. The Supreme Court of Missouri denied transfer, leaving the favorable appellate decision intact and preserving the retirement system. Congratulations to Partners Tyson "Ty" Ketchum, Kevin Prewitt, Paul Brusati, and Senior Associate Nick Slovikoski on obtaining this outcome.

Armstrong Teasdale was recently part of the trial team that secured a complete defense verdict for Mead Johnson in a high-profile baby formula trial in the City of St. Louis, one of the country's most challenging jurisdictions for corporate defendants. The firm's health care litigation and appellate teams served as integrated trial counsel throughout the two-week jury trial, arguing motions, drafting and presenting jury instructions, preparing bench briefs, and developing and implementing trial strategy. The jury returned a complete defense verdict. Congratulations to Partners William Ray Price, Maureen Bryan, Paul Brusati, Senior Associate Colleen Kinsey, and Associate Chase Rose on achieving this outstanding result for our client.
