Dr. Park advises on controversy, litigation, audit defense, and advance pricing agreement matters.     How do you put a monetary value "moral damages"? In international treaty arbitration, moral damages claims are becoming increasingly common but lack established methodologies on how to quantify. Awards often rely on ad hoc amounts, making outcomes difficult to predict or reconcile and leaving many parties unsatisfied. Manuel Angel Abdala and Franco Abdala-Arata demonstrate four established economic techniques that can help quantify moral damages in a more transparent, consistent, and analytically rigorous way.     Not all industries face equal dispute risk in 2026, with two sectors in particular demanding closer attention, according to BRG's seventh-annual M&A Disputes Report Financial services retained its position as the dominant dispute hotspot: 51% of respondents reported increased activity there in 2025, up from 43% in 2024. But the more telling stories involve what is happening in energy and climate and in healthcare and life sciences. Energy and climate is the breakout sector for 2026, with 44% of respondents expecting disputes to increase—the largest forward-looking gain of any industry. In EMEA, that figure rises to one in two respondents, the highest share of any region for any sector. The energy transition brings enormous deal activity but also structural complexity: assets that are difficult to value, long-dated performance metrics and evolving regulatory obligations create fertile ground for post-closing conflict. Healthcare follows a similar trajectory, driven by an intensification of regulatory scrutiny at both the federal and state levels. Meanwhile, FinTech tells the opposite story. Just 29% expect FinTech disputes to rise in 2026—a sharp drop from the 40% who reported an increase in 2025 and well below the 45% who had predicted that growth a year ago. As regulatory frameworks mature and market volatility stabilises in parts of the sector, dispute exposure is moderating. The dispute landscape is shifting sector by sector.
