The insured asserted that it was entitled to an automatic extended reporting period upon the expiration of the policy both as a matter of statutory law and contract, thus entitling it to coverage for a claim first made one week after the policy’s expiration. Brian and Noah successfully argued that the statutory scheme relied on by the insured did not apply to policies issued through the surplus lines market and that the insured was not otherwise entitled to an extended reporting period since it had replaced the policy’s coverage upon its expiration. #KBRLaw #SummaryJudgment

KBR congratulates Philip Artusa for securing a unanimous defense verdict in Orange County. The trial involved allegations of medical malpractice in connection with an abdominal surgery. While the claims against the Hospital were originally grounded in vicarious liability, mid-trial the theories of liability were expanded to include direct allegations against nursing staff, residents and covering physicians. Phil argued that the plaintiff’s injuries were attributable to nearly two decades of prior radiation damage and unrelated to any alleged negligence or malpractice by the Hospital staff. The jury returned a unanimous defense verdict in favor of the Hospital. #KBRLaw #DefenseVerdict

Congratulations to KBR attorneys Ari Lessa and Adi Halevi on securing summary judgment in a dental malpractice action in Queens Supreme Court. The plaintiff alleged that an alveoplasty procedure was negligently performed, resulting in nerve damage and loss of sensation to the lip, tongue, chin, and inside of the mouth. The Court granted summary judgment in favor of our client, finding that the procedure was performed within the accepted standard of care, informed consent was properly obtained, and the alleged nerve injury was a known and accepted risk of the procedure. The Court further held that our client could not be held vicariously liable for the actions of other dental providers, as he neither operated the practice nor directly employed the treating providers. As a result, all claims against our client were dismissed. #KBRLaw #MedicalMalpractice

Congratulations to KBR attorney Christine Rockwell on securing a unanimous defense verdict in Nassau County Supreme Court on behalf of a hospital client. The case involved allegations that the hospital negligently failed to prevent skin breakdown in a patient suffering from terminal metastatic prostate cancer.
