KBK attorneys Emma Tehrani and Tia Baheri, serving pro bono with help from Public Counsel, secured a complete habeas victory for a young asylum seeker unlawfully detained by ICE. The asylum seeker, who had been working as a gardener to support his family, was illegally detained after appearing for a routine ICE appointment in full compliance with the conditions of his supervision. Over the course of the case, the federal court ordered his release, required removal of an ankle monitor, and on July 10 entered final judgment in his favor, allowing him to pursue asylum without fear of re-detention absent due process. As part of the United States Supreme Court’s landmark June 30 decision upholding birthright citizenship, both Chief Justice John Roberts’ majority opinion and the concurring opinion authored by Justice Ketanji Brown Jackson relied extensively on historical sources and analysis provided to the Court in the amicus curiae brief filed by KBK Partner Richard Kendall on behalf of historians Martha S. Jones and Kate Masur.
