Sometimes the first negotiation isn't over dollars. It's over who's responsible for the damages. In this high-exposure construction injury case, four defendants, multiple insurance carriers, competing coverage positions, and indemnification claims meant there was no clear path to settlement. James W. Borkowski, Esq. recognized a traditional joint mediation would fail before it started. Instead, he restructured the process, holding two defense-only sessions to untangle coverage disputes, establish consensus among the defendants and carriers, and create the foundation for meaningful settlement discussions. By solving the procedural obstacles first, James W. Borkowski transformed a case that appeared impossible to resolve into one that could finally be negotiated. After approximately 30 hours of mediation, the matter resolved for $5.51 million, avoiding years of additional litigation, significant trial costs, and the uncertainty surrounding pending Labor Law § 240 issues.
