If you have a federal project with Endangered Species Act (ESA) implications, a recent ruling from the Northern District of California is worth your attention. On March 30, the court vacated four core Section 7 consultation regulations, reinstating the pre-2019 framework. The most immediate consequences: pending biological opinions are paused while the Services develop guidance, and projects built around non-binding mitigation measures may need to restructure those commitments to count in the jeopardy analysis. The Services are expected to appeal, and a separate rulemaking proposed in November 2025 (anticipated to be finalized later this year) would re-adopt much of what was just vacated. This year’s competition raised funds for the St. Mary’s Episcopal Church food pantry ministry, which enables 500 households to shop each month for dry and canned goods, fresh bread, meat and produce free of charge. The annual cook-off is one of the most popular Jax Bar events of the year, and we look forward to defending our title in 2027!
