In a recent decision, the Court of First Instance of Hong Kong provided clarity on how mortgagees can resolve the difficulties that arise from a matrimonial claim registered against the mortgaged property. In Sun Hung Kai Credit Limited v Lam Lai Wah Lindy (HCMP 472/2025, [2026] HKCFI 2686), the Court applied the doctrine of estoppel by standing by to this context, and established a practical avenue for lenders to apply to vacate the registration of a notice of application for ancillary relief where a non-registered owner spouse has chosen not to intervene in the mortgagee proceedings.
