Dr Danielle Tyson is Senior Lecturer in Criminology at Deakin University and Co-Director of the Monash-Deakin Filicide Research Hub.

Dr Danielle Tyson’s research focuses on gender, violence and culture; legal responses to intimate partner homicide; homicide law reform; filicide in the context of separation; and gender, justice and sentencing.

Danielle joined the Department of Criminology in the School of Humanities and Social Sciences at Deakin University in 2016. Prior to this she taught Criminology at Monash University, Australia, the University of Brighton, England, and at the University of Melbourne, Australia, and Legal Studies at La Trobe University, Victoria, Australia.

The partial defence of provocation is one of the most controversial doctrines within the criminal... more The partial defence of provocation is one of the most controversial doctrines within the criminal law. It has now been abolished in a number of international jurisdictions. Addressing the trajectory of debates about reform of the provocation defence across different jurisdictions, Sex, Culpability and the Defence of Provocation considers the construction and representation of subjectivity and sexual difference in legal narrations of intimate partner homicide. Undeniably, the most vexing exculpatory cultural narrative of our times is that of a woman 'asking for it'. This book explores how the process of judgment in a criminal trial involves not only the drawing of inferences from the facts of a particular case, but also operates to deliver a narrative. Law, it is argued, constructs a narrative of how the female body incites male violence. And, pursuing an approach that is informed by socio-legal studies, literary theory and feminist theories of the body, Sex, Culpability and the Defence of Provocation considers how this narrative is constructed via a range of discursive practices that position woman as a threat to masculine norms of propriety and autonomy. Once we have a clear understanding of the significance of narrative in legal decision-making, we can then formulate textual strategies of resistance to the violence of law's victim-blaming narratives by rewriting them.

Reforming Defences to Homicide in Victoria: Another Attempt to Address the Gender Question

In 2005 in the Australian state of Victoria, significant changes were made to the defences to hom... more In 2005 in the Australian state of Victoria, significant changes were made to the defences to homicide. These reforms were in response to long standing concerns about the gendered operation of provocation and self‐defence by feminist researchers and advocates, Law Reform Commissions, the media and political pressures. This paper critically examines the reforms and the extent to which they have addressed these varied concerns and interests. The paper argues that these important law reforms have challenged some of the powerful narratives being used in the courts that minimise the existence and significance of family violence in intimate relationships. We see this particularly in judicial sentencing remarks. However, law reform must be accompanied by a shift in legal culture to be effective in practice. To this end, we argue that legal professionals need to have information about how to utilise the new family violence provisions as well as ongoing training and professional development to promote consistent understandings of family violence across the criminal justice system.

Filicide is the deliberate act of a parent killing a child. Despite its low occurrence, filicide ... more Filicide is the deliberate act of a parent killing a child. Despite its low occurrence, filicide is one of the most emotive offenses for a public audience. The murder of a child by their own parent challenges many of our fundamental expectations about the role of parenthood, prompting a sense of horror, outrage, and deep distress: It violates the idea of parental instincts as a protection for children. While maternal and paternal filicide is committed in roughly equal numbers, historically, filicide has been regarded as a female crime. However, media coverage of mothers who commit filicide differs from coverage of fathers who commit the same crime. Infanticidal mothers in particular have a long history of being demonized by the media and in popular culture. Research shows that this is partly because such events shatter expected feminine and maternal norms. Despite the considerable body of scholarly work conducted in this area of crime and media culture, there were few studies of filicide in Australia until recently. As a consequence, the media’s portrayal of these tragic cases is to treat them as “inexplicable” while also attempting to find an explanation, most often through stereotyping, simplification, or rationalization.
