Over the last decades lawyers and experts in the field of law have increasingly moved beyond advi... more Over the last decades lawyers and experts in the field of law have increasingly moved beyond advisory and representative roles towards neutral, non-aligned interventions, and have developed new professional techniques in aid of new settlement strategies. Despite cultural diversity and variations over time, the different contexts within which informal principles of justice have often been found reveal a prevalent trend to create alternatives to adjudication for handling disputes, such as negotiation and mediation processes. The present analysis focuses on the linguistic skills and communication strategies that experts need to know and apply when conducting a mediation. The aim is to demonstrate that one of the mediator\u2019s initial tasks is to clarify that the persons are not the problem, the issue under discussion is the problem, and they must jointly reconsider it. Eventually, reframing and construction begin with the idea that a story of cooperation already exists and only needs to be uncovered

Attraverso la legislazione il governo disciplina le attivita dei cittadini nel rispetto del manifesto elettorale della forza politica che lo sostiene. L'attenzione si sposta cosi dalla legislazione come unico scopo del legislative drafting (scrittura della legge), alla legislazione come parte del processo legislativo e come una parte ancora minore del processo politico. Cosi, quando si guarda piu in generale all’intero processo politico, il ruolo di dei legislative drafters puo esser visto per quello che realmente e: un semplice, per quanto fondamentale, anello della catena di governance. Mediation process: increasing language awareness and developing communication skills
European countries have known mediation for a long time. Notwithstanding that, various approaches... more European countries have known mediation for a long time. Notwithstanding that, various approaches and rules of mediation developed in different places all over Europe and Member States still do not have regulated mediation at all (Espluques et al. 2012). The European Union has tackled this problem with the aim to change mediation into a flexible and useful tool for the parties to solve their disputes in civil and commercial matters. The objective of this paper is to provide first a general overview of mediation process on the basis of the Directive 2008/52/EC of the European Parliament and the Council on certain aspects of mediation in civil and commercial matters. Then, attention will be focused on the language skills and linguistic strategies for practitioners who deal with mediation process, making them aware of the peculiarities of mediation discourse and able to adapt the process to meet the particular circumstances in a knowledgeable way

Legal translation entails a basic knowledge of the legal systems involved, familiarity with the r... more Legal translation entails a basic knowledge of the legal systems involved, familiarity with the relevant terminology and competency in the specific legal writing style of the target language. Apart from terminological lacunae and lexical gaps, the translator has to consider not only the textual conventions in the source language that are often culture-dependent and may not correspond to conventions in the target culture, but also the linguistic structures found in the source language that may have no equivalent structures in the target language. In this this regard, the EU carries this process to new heights for a number of reasons: it is a novel creation; law plays a central part in the existence of the EU, and law is expressed in words; EU is a multilingual organisation bringing together specialists from different national cultures who work together in their own environment, sometimes referred to as the \u2018Brussels bubble\u2019. The comparative analysis of a corpus of EU Directives on criminal justice (2004-2012) and their Italian version illustrates that the Italian text adopts literal translation of words and phrasemes which may lead to ambiguous/erroneous interpretation of the target text and cause problems to an Italian legal audience if only translational equivalents are used

Pur nella diversit\ue0 di metodologie e regole della mediazione presenti nei paesi membri, sono riscontrabili tratti comuni che tuttavia necessiterebbero di una regolamentazione univoca per tutto il territorio europeo. Il ruolo assunto dall\u2019esperienza comunitaria in materia di conciliazione \ue8 assai rilevante, in quanto lo strumento della mediazione ha ricevuto un importante sviluppo grazie alle direttive europee aventi lo scopo di adeguare le legislazioni degli Stati membri in materia di Alternatitve Dispute Resolution (ADR), dapprima in materia societaria e commerciale, successivamente in materia di consumo e nei rapporti tra singoli cittadini ed istituzioni, nonch\ue9 le istituzioni tra loro.costruiamo della realt\ue0 al livello mentale. A tal proposito, recenti sviluppi nel campo della teoria sociale postmoderna e del movimento costruzionista nelle scienze sociali hanno prodotto interessanti risultati nel campo della mediazione e risoluzione dei conflitti. Tali sviluppi si basano sull\u2019applicazione di un nuovo metodo, definito narrative approach, attraverso il quale \ue8 possibile osservare il modo in cui il linguaggio usato per descrivere e intendere il conflitto o disputa rifletta l\u2019immagine che noi stessi I principi teoretici che stanno alla base della \u2018mediazione narrativa\u2019 o \u2018mediazione dialogica\u2019 si pongono in linea con la ricerca condotta dall\u2019autrice su un corpus di documenti raccolti nel campo della mediazione. Attraverso la scomposizione e destrutturazione del discorso caratterizzante le situazioni conflittuali osservate, l\u2019analisi dimostra che i mediatori possono: (i) comprendere meglio premesse e posizioni ideologiche che i soggetti partecipanti alla mediazione portano in relazione al conflitto stesso; (ii) diventare pi\uf9 consapevoli delle specificit\ue0 del dialogo che intercorre nella mediazione; (iii) acquisire una migliore capacit\ue0 nell\u2019adattare il dialogo alla specifiche circostanze del conflitto che si intende risolvere attraverso la mediazione

Generally speaking, words can be elusive and they need to be carefully selected when conveying me... more Generally speaking, words can be elusive and they need to be carefully selected when conveying messages, ideas and proposals between parties. This is all the more evident in mediation process as language has to be neutral and mediators should avoid expressions directing parties. In this regard, recent theoretical developments in postmodern social theory and the social constructionist movement in the social sciences and humanities have provided the field of alternative dispute resolution with a new approach to managing and mediating conflicts. These developments are organized around the 'narrative approach' which helps us to see how the language we use to describe and understand our conflicts are is operative in constructing an image in our minds of the conflict itself. The research conducted in this paper is in line with the theoretical principles behind the narrative mediation. By reframing the discourses surrounding the conflict situation, the analysis demonstrates that mediators might become aware of the peculiarities of mediation discourse and might be able to adapt the process to meet the particular circumstances in a knowledgeable way.
