The activity of the Spanish Presidency in the field of defense of the EU is restricted by two obs... more The activity of the Spanish Presidency in the field of defense of the EU is restricted by two obstacles: 1) the new institutional structure of the EU, derived from the reforms introduced by the Treaty of Lisbon, which means the new regulation of the European Council, with its own President, and the introduction of the Foreign Affairs Council, with its own President –the High Representative–, both with competence for the direction and execution of the EU's defense policy. And 2) the definition that the TUE makes of the EU's defense policy, distinguishing between the common security and defense policy (CSDP), which is perfectly defined by the Treaty as a policy aimed at crisis management, and what is the defense policy of the EU, in proper terms. Policy that the TEU itself considers non-existent and subject to a progressive definition. In this sense, the Spanish Presidency has little or no capacity to intervene in the field of the CSDP, but, on the contrary, it has a wide field open to its intervention in the definition and execution of a true defense policy of the EU.

Este trabajo realiza una ordenación y un análisis sistemáticos de las decisiones adoptadas por el... more Este trabajo realiza una ordenación y un análisis sistemáticos de las decisiones adoptadas por el Tribunal Constitucional sobre el conjunto de las actuaciones de la Generalitat de Cataluña conducentes a la consecución de la independencia de esta Comunidad Autónoma, a partir del año 2013. Se trata de autos y sentencias que han producido una doctrina constitucional relevante, tanto sobre aspectos directamente afectados por el proceso independentista catalán —la soberanía de la nación española, la primacía de la Constitución, el referéndum—, como con respecto a otras cuestiones tangenciales. La conclusión del Tribunal Constitucional es que ni las mencionadas actuaciones de la Generalitat de Cataluña conducentes a la consecución de la independencia de esta Comunidad Autónoma, ni los instrumentos jurídicos utilizados hasta el presente con ese fin, tienen cabida ni en la Constitución Española de 1978 ni en el vigente Estatuto de Autonomía de Cataluña que de aquélla se deriva.This article ...

El Tribunal Constitucional Federal alemán emitió el 5 de mayo de 2020 una larga y dura sentencia ... more El Tribunal Constitucional Federal alemán emitió el 5 de mayo de 2020 una larga y dura sentencia (2 BvR 859/15), que viene a contradecir y desautorizar la Sentencia del Tribunal de Justicia de la UE de 11 de diciembre de 2018 (C-493/17, Weiss; ECLI:EU:C:2018:1000). El Tribunal Constitucional Federal no duda en calificar de incomprensible, carente de sentido y, desde luego, ultra vires la decisión del Tribunal de Justicia y el modo en el que se produjo el razonamiento del Alto Tribunal europeo. Lo que está en cuestión en el fondo es el Programa de Compras de Activos del Sector Público (PSPP) del BCE y la propia capacidad del BCE y del SEBC para adoptar ese tipo de decisiones, que pueden exceder su competencia como reguladores de la política monetaria de la UE, para introducirse de lleno en el campo de la política económica. En este trabajo, pues, se analizan y comparan los razonamientos que justifican las respectivas decisiones judiciales y se evalúan sus consecuencias.
In spite of policy impetus, research shows that teachers struggle to address the increasing diver... more In spite of policy impetus, research shows that teachers struggle to address the increasing diversity in classrooms, among others, due to the lack of competences to deal with it. The acquisition of Intercultural Competence (IC), which could be defined as “the ability to mobilise and deploy relevant attitudes, skills, knowledge and values in order to interact effectively and appropriately in different intercultural situations”, is a crucial need for teachers to deal with diversity and to be successful in their teaching. In this context, in 2019 the JRC launched the INNO4DIV project with the aim to support polices in the field of IC of teachers, through the analysis of literature and innovative good practices which have successfully addressed the existing barriers for teacher´s IC development.
