60-Day Public Comment Period for NASA White Sands Test Facility (WSTF) Draft Permit Modification

The New Mexico Environment Department (NMED) intends to issue a Class 3 hazardous waste permit modification to the National Aeronautics and Space Administration (NASA), the owner and operator of White Sands Test Facility (WSTF). This permit modification will accomplish two actions: 1) document sites where corrective action is complete, and 2) to revise the permit to include language that supports the hazardous waste definition amendment for aqueous film-forming foam containing intentionally added per- or polyfluoroalkyl substances [PFAS].

The NASA WSTF is a test facility established in 1962 in support of the National Space Program. WSTF occupies over 60,000 acres in Doña Ana County in south-central New Mexico, 18 miles northeast of Las Cruces, New Mexico and 65 miles north of El Paso, Texas.

Requests for public hearing shall be in writing and shall set forth the reasons why a hearing should be held. A hearing will be held if NMED determines that there is substantial public interest. The NMED Surface Water Quality Bureau opens the comment period for Clean Water Act 401 Certification of the draft National Pollutant Discharge Elimination System permit for the New Mexico Water Service Company Rio del Oro Wastewater Treatment Plant, NPDES permit # NM0030414.

This is a notification that EPA’s public notice and associated federal comment period have been reopened for the draft National Pollutant Discharge Elimination System (NPDES) permit for the New Mexico Water Services Company Rio del Oro Wastewater Treatment Plant (WWTP), NPDES permit number NM0030414.

Additionally, NMED has opened the simultaneous comment period for the Clean Water Act Section 401 Certification of the draft NPDES permit.

When EPA Region 6 drafts a National Pollutant Discharge Elimination System (NPDES) permit for a discharge into one of New Mexico’s surface waters, NMED has an opportunity to assure that the discharge will not negatively affect the receiving waterbodies. This is documented through the 401 Certification and is required in accordance with state regulations at 20.6.2.2001 NMAC. NMED can make the draft permit more stringent if based on state law or can make comments to EPA for consideration in the final permit. NMED also has the authority to deny certification if the permitting circumstances will not guarantee that the discharge will meet water quality standards. 

The facility is located at 401 Horner Street in Belen, Valencia County, New Mexico. The discharges from the facility are to the arroyo called La Canada de La Loma Arena and then to the intermittent stream La Constancia Ditch in Segment 20.6.4.98 NMAC and then to the Rio Grande in Segment 20.6.4.105 NMAC of the Rio Grande Basin in Valencia County, New Mexico.

EPA has included the per- and polyfluorinated substances (PFAS) monitoring requirements based on the memo from EPA headquarters addressing PFAS discharges in NPDES permits and through the pretreatment and monitoring programs.

Anuncio del aviso público sobre el Certificación de la Sección 401 de la Ley de Aguas Limpias

Esta es una notificación de que el aviso público de la EPA y el período federal asociado de comentarios han sido abiertos para el borrador de la planta de tratamiento de aguas residuales del Servicios de Agua de Nuevo México del Rio del Oro, número de permiso del Sistema Nacional de Eliminación de Descargas de Contaminantes (NPDES, por sus siglas en inglés) NM0030414.

Además, NMED ha abierto el período simultáneo de comentarios para la Certificación de la Sección 401 de la Ley de Agua Limpia del borrador del permiso del Sistema Nacional de Eliminación de Descargas de Contaminantes (NPDES, por sus siglas en inglés) mencionado anteriormente.

Cuando la Región 6 de la EPA redacta un permiso del Sistema Nacional de Eliminación de Descargas de Contaminantes (NPDES, por sus siglas en inglés) para una descarga en aguas superficiales de Nuevo México, se requiere que NMED concuerde con que la descarga no afectará negativamente a los cuerpos de agua receptores. Esto se documenta a través de la certificación 401 y se requiere de acuerdo con 20.6.2.2001 NMAC. NMED puede hacer que el borrador del permiso sea más estricto si se basa en la ley estatal o puede hacer comentarios a la EPA para su consideración en el permiso final. The New Mexico Environment Department (NMED) hereby gives notice pursuant to 20.6.2.2001 NMAC of a public comment opportunity in the state’s Clean Water Act §401 Certification of the draft National Pollutant Discharge Elimination System (NPDES) New Mexico Statewide General Permit for Municipal Separate Storm Sewer Systems (MS4s), NPDES permit number NMR04B000, for the following urbanized and designated areas: Albuquerque / Middle Rio Grande urbanized area, Farmington urbanized area, Las Cruces urbanized area, Los Alamos County designated area, Los Lunas urbanized area, Santa Fe urbanized area, and El Paso urbanized area.

When EPA Region 6 drafts a National Pollutant Discharge Elimination System (NPDES) permit for a discharge into one of New Mexico’s surface waters, NMED has an opportunity to assure that the discharge will not negatively affect the receiving waterbodies. This is documented through the 401 Certification and is required in accordance with state regulations at 20.6.2.2001 NMAC. NMED can make the draft permit more stringent if based on state law or can make comments to EPA for consideration in the final permit. NMED also has the authority to deny certification if the permitting circumstances will not guarantee that the discharge will meet water quality standards.

El Departamento de Medio Ambiente de Nuevo México (NMED, por sus siglas en inglés) por la presente notifica de conformidad con 20.6.2.2001 NMAC de una oportunidad para comentarios del público sobre la Certificación §401 de la Ley de Agua Limpia del estado de los borradores número de permiso del Sistema Nacional de Eliminación de Descargas de Contaminantes (NPDES, por sus siglas en inglés) del Permiso General de Aguas Pluviales de Nuevo México para Sistemas Municipales Separados de Alcantarillado pluvial (MS4, , por sus siglas en inglés), número de permiso NMR04B000, correspondiente a las siguientes áreas urbanizadas y designadas: área urbanizada de Albuquerque/Middle Rio Grande, área urbanizada de Farmington, área urbanizada de Las Cruces, área designada del Condado de Los Álamos, área urbanizada de Los Lunas, área urbanizada de Santa Fe y área urbanizada de El Paso.

Cuando la Región 6 de la EPA redacta un permiso del Sistema Nacional de Eliminación de Descargas de Contaminantes (NPDES, por sus siglas en inglés) para una descarga en aguas superficiales de Nuevo México, se requiere que NMED concuerde con que la descarga no afectará negativamente a los cuerpos de agua receptores. Esto se documenta a través de la certificación 401 y se requiere de acuerdo con 20.6.2.2001 NMAC. NMED puede hacer que el borrador del permiso sea más estricto si se basa en la ley estatal o puede hacer comentarios a la EPA para su consideración en el permiso final. NMED también tiene la autoridad para denegar la certificación si las circunstancias de los permisos no garantizan que la descarga cumpla con los estándares de calidad del agua.

Analisis Gratuitos: Analisis de la Calidad Del Agua para Pozos Privados

NMED y NMHealth ofreceran hasta 100 pruebas de agua gratuitas para posoz privados que abastecen a hogares que no estan conectados a un servicio publico de agua en condado de Grant y comunidades circundantes. Las pruebas incluyen: pH, conductividad electrica, nitrato, hierro, sulfato, fluoruro, y arsenico.

Como Recolectar una Muestra de Agua:
  • Llene un recipiente limpio de vidrio o plastico sin olores, con al menos un cuarto de galon o un litro (32 oz) de su agua de pozo.
  • Si la casa tiene un sistema de filtracion para toda la casa, recolecte el agua en la cabecera del pozo antes de cualquier sistema de filtracion o sistema de ablandador, si es posible.
  • Deje correr el agua 2-3 minutos antes de recolectar la muestra.
  • Recoja la muestra lo mas cerca posible del momento de la prueba.

Free Testing: Private Well Water Quality Testing

NMED and NMHealth will be offering up to 100 free water tests for private wells serving homes not connected to a water utility in Grant County and surrounding communities. Tests include: pH, Electrical conductivity, Nitrate, Iron, Sulfate, Fluoride, and Arsenic.

How to Collect a Water Sample:
  • Fill a clean glass or plastic container without any odors, with at least a quart or liter (32 oz) of your well water.
  • If the home has a whole house filtration system, collect the water at the well head prior to any filtration or softener systems, if possible.
  • Let the water run 2-3 minutes before collecting the sample.
  • Collect the sample as close to the time of testing as possible.

Public comment period closes: Groundwater Discharge Permits Proposed for Approval

The New Mexico Environment Department (NMED) Ground Water Quality Bureau (GWQB) hereby provides notice that the following Groundwater Discharge Permits have been proposed for approval. NMED will allow 30 days after the date of publication of this notice (or as otherwise provided in the public notice linked here) for submittal of written comments and/or a request for a public hearing for a permitting action. You can add the comment period to your calendar through our Events Calendar located at https://www.env.nm.gov/events-calendar/. You can now submit your comments online using the Public Comment Portal located at https://nmed.commentinput.com/comment/search. Requests for public hearing shall be in writing and shall set forth the reasons why a hearing should be held. A hearing will be held if NMED determines that there is substantial public interest. After the administrative record for a permitting action is complete and all required information is available, NMED will approve, approve with conditions, or disapprove the Permit based on the administrative record.

NMED maintains a Public Involvement Plan (PIP) for each permitting action to plan for providing public participation opportunities and information that may be needed for the community to participate in a permitting process. La Oficina de Calidad de Aguas Subterráneas (GWQB, por sus siglas en inglés) del Departamento de Medio Ambiente de Nuevo México (NMED, por sus siglas en inglés) notifica por este medio que se han propuesto los siguientes Permisos de Descarga de Agua Subterránea para su aprobación. NMED permitirá 30 días después de la fecha de publicación de este aviso (o según lo dispuesto en el aviso público vinculado aquí) para la presentación de comentarios por escrito y/o una solicitud de audiencia pública para una acción de permiso. Puede añadir el periodo de comentarios a su calendario a través de nuestro Calendario de Eventos situado en https://www.env.nm.gov/events-calendar/. Ahora puede enviar sus comentarios en línea utilizando el Portal de comentarios públicos ubicado en https://nmed.commentinput.com/comment/search.
