On 21 April 2026, on the sidelines of Singapore Maritime Week (SMW) 2026, the Indian delegation held an interaction with the Singapore Chamber of Maritime Arbitration (SCMA), led by Mr. Chao Hick Tin, Chairman, along with senior members of the SCMA leadership. During the interaction, SCMA provided an overview of its role as a maritime arbitration institution, outlining its arbitration framework, standard rules, and its focus on resolving maritime and shipping disputes. Edward Alder gave a session on Maritime Arbitration on the morning of Sunday 26 April (Day 9) of the Ciarb (East Asia Branch) 2026 Asia-Pacific Diploma in International Commercial Arbitration. This prestigious APAC Diploma has been designed to meet the increasing demand for accredited arbitrators and arbitration practitioners to resolve cross-border disputes in the Asia-Pacific region. Maritime Arbitration is one of several 'specialty areas’ on the course along with construction and investor-state arbitration. The East Asia Branch is one of Chartered Institute of Arbitrators (Ciarb)'s largest Branches, spanning Hong Kong, Macau, Taiwan and mainland China, South Korea, Japan, Indonesia, the Philippines, Vietnam, Cambodia, Myanmar, Mongolia and Laos. International Arbitration and National Courts: Kazakh Court Enforcement of International Arbitral Award Re-confirms Support for International Arbitration A court in the Astana International Financial Centre has enforced an award ordering an Indian industrial conveyor belt supplier to pay more than US$8 million to a Kazakh steel producer. The Court of the Astana International Financial Centre (AIFC) enforced a foreign arbitral award on 19 April 2026 against an Indian industrial conveyor belt supplier. The supplier was ordered to pay over US$8 million to a Kazakh steel producer.    This ruling is significant as it demonstrates the AIFC Court's capability to enforce international arbitration awards against foreign entities with assets or obligations within its jurisdiction. The AIFC Court operates under a legal framework based on the principles of English Common Law, designed to provide a familiar and stable environment for international investors and commercial disputes.    This case follows a broader trend of Central Asian courts, particularly in Kazakhstan, becoming more active in the international arbitration and enforcement landscape. Jeremy Bartlett SC has been appointed to the Shanghai International Arbitration Center (SHIAC) Cooperation and Development Department Panel of Arbitrators for the 2026-2031 term.   SHIAC is one of Mainland China’s most established international commercial arbitration institutions, administering arbitrations involving parties from over 85 jurisdictions worldwide. It was founded in 1988 and handles both domestic and cross‑border commercial disputes across sectors such as finance, construction, international trade, shipping and energy, along with leading bodies such as China International Economic and Trade Arbitration Commission (CIETAC) and Beijing Arbitration Commission/Beijing International Arbitration Court.

The creation of the new Maritime, Port and Foreign Trade Arbitration Chamber in Brazil marks an important development for the Brazilian maritime industry. I am very pleased to have been invited both to join its panel of arbitrators and to speak at its 1st Congress on Monday, 11 May. The establishment of a specialized arbitration chamber dedicated to maritime, port and international trade matters represents an important step forward for the development of legal certainty, technical expertise and efficiency in the resolution of disputes within the Brazilian shipping industry. My presentation will address a topic of great practical relevance to the international maritime market: the effectiveness of arbitration clauses agreed in charter parties and bills of lading, particularly the need for such clauses to be enforceable against cargo insurers pursuing cargo claims. The effectiveness of arbitration depends not only on the formal validity of arbitration agreements, but also on the practical ability to avoid the fragmentation of disputes and parallel proceedings that undermine predictability, uniformity of decisions and the legitimate expectations of the parties when electing arbitration as their chosen dispute resolution mechanism.
