The insurance company valued your workers' comp claim before you said a word. Negotiation advice often says the person who names the first number controls the range. True. But in workers' comp, you're rarely first. By the time you make a settlement demand, the carrier has already priced the claim through reserves, medical projections, and its own evaluation of future exposure. That number is the real anchor. You just don't get to see it. So when an adjuster asks you to "send a demand," your number isn't landing on a blank slate. It's being compared against a valuation the carrier has already built. A huge opening number, by itself, does little against someone who prices claims for a living. Anchoring research suggests experienced negotiators are less susceptible to the effect - though not immune. What moves the file is evidence that makes the carrier's existing valuation harder to defend. Suppose the insurer expects your treatment to wind down to occasional pain-management visits. Then your surgeon documents that a lumbar fusion is likely within five years. The problem for the carrier isn't that you demanded more money. The future it priced just changed. That's the difference between an anchor that gets dismissed and one that pulls the settlement toward your number. Your job isn't to invent a bigger number. It's to prove the insurer's invisible one is wrong.
