Superdiversity and sub-national autonomous regions: perspectives from the South Tyrolean case

This chapter discusses whether the policies aimed at protecting the historical traditional minori... more This chapter discusses whether the policies aimed at protecting the historical traditional minorities in South Tyrol help or hinder the creation of a tolerant and pluralistic society, and enable a defensive approach so far adopted by the South Tyrol authorities towards migration and the cultural diversity of migrants and their families. It relies primarily on the analysis of legal and policy documents, and judgments of national and international courts as well previous literature and empirical studies on South Tyrol. The chapter focuses on the competences of the South Tyrolean authorities and the measures introduced by them as regards integration and inclusion. It also looks at several recent rulings, concerning the Province of Bozen/Bolzano, by the Italian Constitutional Court and the European Court of Justice. The chapter concludes with observations on how to develop a defensible framework for the management of new and more complex forms of diversity at the subnational autonomous level in, but also beyond, the South Tyrolean case that reconciles unity and diversity and that overcomes, at the same time, the traditional 'old–new' minority dichotomy.

Senior Researcher presso l'Istituto sui Diritti delle Minoranze dell'Accademia Europea di Bolzano... more Senior Researcher presso l'Istituto sui Diritti delle Minoranze dell'Accademia Europea di Bolzano/Bozen (EURAC). È giurista internazionalista specializzata nella protezione dei diritti umani e delle minoranze. Dopo aver conseguito la laurea in giurisprudenza ed ottenuto il Master (LL.M.) in International Human Rights Law presso l'Università di Essex (UK), ha conseguito il titolo di dottore di ricerca (PhD) presso la Facoltà di giurisprudenza dell'Università di Graz (AT). Ha lavorato presso diverse organizzazioni internazionali: in Bosnia, per l'Alto Commissariato per i Rifugiati delle Nazioni Unite (ACNUR), in Albania, per l'Organizzazione per la Sicurezza e la Cooperazione in Europa (OSCE), a Ginevra, per il Centro per i Diritti Umani delle Nazioni Unite, a Strasburgo, per la Corte Europea dei Diritti dell'Uomo (CEDU). Attualmente, presso l'Accademia Europea si occupa della protezione delle minoranze in campo internazionale, in particolare delle nuove minoranze originate dall'immigrazione, ed in questo ambito ha pubblicato molteplici contributi scientifici su riviste e volumi nazionali ed esteri. La sua ultima monografia è "Nuove Minoranze. Immigrazione tra diversità culturale e coesione sociale" (Cedam, Padova, 2010). Nel 2011 ha curato, insieme a Rainer Girardi, l'edizione del "Primo Rapporto Annuale sull'Immigrazione in Alto Adige 2010" (Eurac, 2011). The categories emanating from international human rights law defining the belonging of peoples to... more The categories emanating from international human rights law defining the belonging of peoples to different types of minorities invites for a re-assessment. These different minority categories such as indigenous peoples, national (historical) minorities and migrants tend to fix people to different types or levels of specific protection. The justifications for different treatment are, however, not born in a vacuum or value-free, and they rarely fit seamlessly with real life cases of needs of minorities. Thus, in this article I shall discuss the legitimacy and consequences of the current typology, which divides minorities into different categories. This categorization has direct consequences for the rights people can claim vis-à-vis their governments and the international community. To illustrate the key concerns with the contemporary categorization of minorities, this article presents the case of Roma and their current struggles to fit their claims and needs into the existing minority rights framework.*

While conflicts involving language are always intertwined with other issues such as ethnic and ra... more While conflicts involving language are always intertwined with other issues such as ethnic and racial identity, religion, and democratic participation, the importance of the linguistic dimension is often underestimated, along with the difficulties of achieving effective, just and sustainable solutions through language legislation and policy. Language policies have political and social consequences; they can reinforce or diffuse conflicts and social unrest between language groups, they can accelerate language loss or facilitate language revitalization, and they can be instruments of inclusion or exclusion affecting the stability and security of the society. Against this background, this Special Issue aims to shed light on how language diversity impacts conflict and security.
